Tabu: Delhi High Court gives interim relief to Tabu for plea regarding personality rights, directs online platforms to remove obscene, AI generated content targetting her | Hindi Movie News

The Delhi High Court has granted interim protection to Tabu against the unauthorised use of her name, image and other personality attributes, directing online platforms to remove obscene and pornographic content targeting her.In an order passed on August 6, Justice Jyoti Singh instructed intermediaries including Meta (Facebook and Instagram), Google, X, Reddit, eBay and GoDaddy to take down webpages found to be violating Tabu’s personality rights within 36 hours.The court has also directed these platforms to share the Basic Subscriber Information and IP log details of individuals who anonymously uploaded the allegedly infringing material. The information has to be provided within three weeks, according to the order.Tabu approached the High Court seeking the removal of AI-generated obscene content featuring her, along with unauthorised merchandise being sold using her name and personality traits. She also sought legal action against those commercially exploiting her name, photographs, videos and other identifying attributes without permission.The actress further raised concerns over entities offering fake bookings for performances and events in her name.While granting interim relief, the court took note of Tabu’s stature and longstanding popularity, observing that her public profile entitled her to protection from false, derogatory and unauthorised online content.The court observed, “Plaintiff (Tabu) is a world renowned and critically acclaimed and a celebrated actress, who has left a mark in the film industry, both in India and internationally, with her stellar performances over three decades. There is no gainsaying that Plaintiff’s name and moniker/stage name ‘Tabu’ and her image, voice, likeness and other attributes of her personality have acquired unique distinctiveness and are associated with her instantly by members of public,” it observed.The High Court also agreed with Tabu’s argument that AI-generated videos infringing her personality rights could cause lasting damage to her reputation, goodwill and the commercial value associated with her brand endorsements.As a result, the court restrained the misuse, exploitation and misappropriation of Tabu’s personality attributes while granting her interim protection.The matter is scheduled to come up for its next hearing on December 7.Tabu was represented before the court by Senior Advocate Swathi Sukumar, along with advocates Rohan Talwar, Deeksha Jani, Preksha Diwakar, Anirudh Bhatia, Jinay Jain, Rishika Aggarwal, Ritik Raghuwanshi and Anshu Tulsyan.
